Page 151 para 3) Sims ...I was assigned to search the southwest upstairs bedroom. This bedroom I learned belonged to Mechell Moore, Debora Morre’s daughter. Det. Mumma advised that currency was listed on the search warrant. During the search of the southwest bedroom I located $470.00 in U.S. currency. The currency was found inside a bule bank book. The currency was located along the east wall in the southwest bedroom. This money was taken to the 4th floor of the city building where I turned the money in as evidence.

Stone # 1352

16 3 20 96 - para 1) During the time that I was at Clark Ownes residence having the search warrant signed we discussed the case as I described to him some of the circumstances around it. He asked whether we were intending to have a dog at the scene in order to search for drugs and I told him that we were not sure at this time because the dog handler had in-service training earlier in the day and was not on duty at this time. ... Owens appeared to be familiar with the previous case that was referred to during the application of the search warrnat and did not ask us very many questions relating to it. ...Once myself and Asst. District Attorney Rithaler were done at the judges residence I then returned back to the city building after dropping the asst. District attorney.

17 para 1) I was wearing the issued raid equipment. This consisted of a black kevlar and balck goggles along with a black T-shirt with the word “police” in large white letters on both...I was equipped with a nomex hood however I was not wearing it pulled down over my face ...I had it with me so that once the entry was made and we had people restrained and/or in custody that I could put the hood down over my face in order to conceal my identity from the occupants of the residence.

18 bottom para) Det. Mumma had made entry into the detached garage aftrer talking with the occupants of 2740 E. 2nd.

19 para 1) The Interior of the garage was stacked from floor to approx. Head high for the majority of the garage with boxes and other items....Both of these bags of marijuana were turned over by myself to Det. Mumma in order for him to process the plastic bags for fingerprints.

Para 3) After I wnet to the computer room which Det. Otis was currently searching. We had already located a computer which had around it some various propaganda and information in reference to hemp and marijuana. I had prior permission from reviewing the 1992 search warrant case in which an unknown person had called the crimestoppers and indicated that Ms. Moore had said that if we had taken her address book and directly during that warrant that we would have put her out of business. [Meaning sewing business]. ...We had specified the computer files in the warrants so I begin to examine the computer which was in the computer room which Det. Otis was currently searching.

Page 20 para 1) ...I continued searching and in the register drawer underneath the counter of the north area of the room I took $107.38 in U. S. Currency from the drawer...A mental set of drawers with various labels. One of these drawers was labeled sugar and upon opening it I found a large wad of bills within this drawer. I recovered $264.00 in U.S. currency from this drawer.

Page 21 para 1) ...We then secured the front door using the dead bolt on the front door due to the fact that it had not been damaged when Det. Mumma forced the door. [THIS IS NOT TRUE - THE WHOLE FACING WAS DESTROYED, AND THE DOOR COULD ONLY BE HELD CLOSED BY THE CHAIN LATCH]

Several of these detectives were wearing black hoods over their heads in order to protect their identity from Mechell Moore and Debora Moore placed on the possibility that we may have future contact with them and they wanted to remain unknown to her at this time.

Page 129 para 3) “She had them labeled in her shop as vases or other items”...

para 4) From these file cabinets I removed a home made book labeled “Pressed Leafs Hemp” in the file labeled address books which contained papers with various name and information on it. I also removed a file labeled Tax Stamps and a file labeled mailing lists masters. ...In the home made book labeled “Pressed Leafs Hemp” I found numerous whole pressed leave which appeared to be marijuana leaves. I removed all the leves from this book and submitted them as evidence under this case number. Page 20...Para 1) ...There were also some photos from a standing file which was on the floor in the southeast corner. Upon looking through these photos I saw several photos which appeared to be taken at various rallies for gatherings. In some of these photos were people that appeared to be using or processing or preparing to use marijuana. Debbie Moore and her daughter, Mechelle Moore, were also present in some of these photos. All of these items were collected at 0011 hours on 3 21 96.

Page 28 para 2) Then started on the east side of the file cabinets where officer sims started on the west side. At 2217 hours on 3 20 96 I open up the far east file cabinet, this bing the top file, and in the back row of this file cabinet I located one white in color, what appeared to be a plastic office max sack. Whem I open up this sack I saw numerous what appeared to be plastic bags and inside these plastic bags there appeared to be a green botantical substance. After I had located the plastic sack with the individually wraped bags I notified Det. Stone who did come to my location where he took a photograph of this evidence.

Para 3) I then continued my search of the file cabinets where at 2226 hours on 3 20 96 again in the south room of the basement, north wall, searching the file cabinets, on the second cabinet from the east, the top drawer, middle compartment, I located one scale which was tan in color. This scale had the name “o’Haus” portogram scale with the serial number H440 53 87 on the bottom. Det. Stone also took a photograph of this scale. After I located the scale I had placed the evidence that I had found at this time, this bing the office max plastic sacks with the individually wrapped packages, the coleman cooler and the items listed above inside and the scale on the pool table for collection. [NOTE THAT THE SCALE DID NOT WORK, IT WAS RETURNED BROKEN BY POLICE IN 1994. IT STILL HAD THE MARKINGS OF THE POLICE DEPARTMENT ON IT. STRICTLY A “KEEPSAKE”]

para 5) ...I also had the opportunity to go through the office max plastic sack. I counted 38 individually wrapped plastic bags which what appeared to be a green botantical substance inside. I also located on individually wrapped plastic bag which contained 16 white cigarette joints which appeared to have a green botanical sutstance inside. These items, along with the 4 individually wrapped plastic bags which contanined what appeared to be a green botanical substance which I had located in the cooler was placed in an evidence bag. It is noted that on each individually wrapped blastic bag I did place a letter and a number on each one. The letters were B, and then were numbered consecutively 1 through 39. The 4 individually wrapped plastic bags with what appeared to be a green botanical substance inside which I had located at coleman cooler was marked with the letter A and then consecutrively and marked 1 through 4.

Page 42 Para 5) Whittredge I then assisted in searching the porch area and I did find along the south wall on some metal shelving a box containing a set of scales. In this particular box was what appeared to be a marijuana seed and some green botanical substance that did appear to be marijuana to me. I did point this item out to Det. Stone who was collecting evidence.

Otis

Page 39 para 5) Otis While searching the drawers of the sewing table I opened the Top left hand drawer and laying directly on top of the misc items in the drawer was U. S. Currency. This currency was setting on top of several ziplock baggies. These ziplock Baggies have what appeared to be green and brown residue in it which could have been marijuana residue. I took the money and counted it. There was $410.00 in assorted U. S. Currency. I seized the U. S. Currency as well as the 17 ziplock baggies.

Page 40 para 1) Otis In the top desk drawer of the same desk I found $12.00 more in U.S. currency which I seized. In the top right hand drawer of this desk I found $65.00 in assorted U.S. Currency which I also seized. I found nothing else in the desk that was countraband or seizable.

Para 2) Otis I then begin to search a standup dresser/cabinet that was just to the right of the sewing table. There was a lot of magazines and assorted documentation in it. There was a cardboard box setting on a shelf inside of this cabinet and upon looking into the cardboard box I found receipts for Kansas Marijuana Tax Stamps in which someone had purchased. There was also other documents in reference to Marijuana Tax Stamps, as well as phone records, etc. I seized this box with all of the documents.

Para 5) Otis ...As I prepared to turn in the U.S. currency that I had seized from the house on east 2nd, Det. Stone contacted me and advised that he had a photocopy of money he had used for a controlled buy of drugs at that location going through the U. S. Currency that I had seized to see if any of it matched up with the money he had used during the controlled buy at that location. While looking through the $20.00 bills that had been in the $410.00 that I had seized from the top left drawer of the sewing table we found the 3 $20.00 bills that had been used for the controlled buy. Det. Stone showed me the photocopy he had made of the money he had used and I found the matching $20.00 bills which were serial numbered B75289321N, L57271946A, and E81232248A. Det. Stone then took those $20.00 Bills, photocopied them again and returned the photocopy to me.

Para 6) Otis I then submitted the items I had seized from the residence on 3 2nd, being U.S. currency, the documents, the photocopy of the 3 $20.00 bills Det. Stone had taken as well as the rolodex. I also submitted the 17 clear ziplock baggies which contained residue. I submitted these to the WPD Forensic laboratory so that the residue inside the baggies could be analyzed to determine whether it was marijuana residue or not.

Dear Editor of the Washington Post:

I am writing to you because I believe the Washington Post through years of demonstrated reporting to be more honest than most other media’s in exposing truth & facts.

I inquired recently as to exactly what urine analysis given by law enforcement agencies were detecting in urine. Was it tetrahydrcabbabinol (THC) the psychoactive or hallucinogenic properties of the Cannabis plant, a.k.a. marijuana, or were they detecting cannibinoids in general which according to the following Federal Appellate Court Decision of 1975 are legal to consume by the human body:

"....We first note the concession by Walton's expert that all the species of marijuana possess the toxic agent 'tetrahydrocannabinol," popularly known as THC. It is conceded that the "hallucinogenic" or euphoric effects produced by this agent led to the Congressional ban on possession, importation and distribution of marijuana. The most cursory reading of the legislative history of the various provisions outlawing marijuana permit no other conclusion." [202]

"The law under which Walton was convicted was enacted as part of the Controlled Substances Act of 1970, but the definition of marijuana in that Act was carried forward without comment from the Marijuana Tax Act of 1937. Looking at the legislative history of this latter law, we find that the definition of marijuana was intended to include those parts of marijuana which contain THC and to exclude those parts which do not." [203]

..."the clear purpose of the law is to proscribe the euphoric effect of THC..." [204]

395 Same as page 78 - Otis - Photo Copy of 3 $20.00 Bills “ [think this is suppose to be CI buy money? Please note that there is no actual copy of the three $20.00 bills in this book of evidence you have here, that are listed in the Otis report.] Page 40 Para 5) Otis ...As I prepared to turn in the U.S. currency that I had seized from the house on east 2nd, Det.

***There are some more pages of info about infomant, I do not have them outlined yet, but I have read them. This is how they justified getting the first search warrant signed. So why won’t they identify who it is suppose to be?

[NOTE FROM DEBBY TO CHARLIE: THERE WAS NEVER ANY CONTROLLED BUY!!! - THIS DID NOT HAPPEN, IT COULD HAVE NOT HAPPENED - I DID NOT EVER SELL MARIJUANA SINCE 1992 AS I PROMISED YOU I WOULD NOT!]

Page 32 para 3) Det. Stone Stated that due to the previous problems that we had experienced with this residence, and the possibility that Federal charges could come out of this search warrant, we were preparing to do a 10 second count before making entrance to the house and after we had knocked and announced. ...All members of the entry team were also wearing helments and goggles.

Page 33 para 2) ...I did observe as officer Sims knocked loudly on the door, using a large pry bar type screwdriver.

para 3) ...I made contact at the front door of the adjacent apt. And spoke to the residents who were at home. They expressed relief to know that this was in fact the police executing a search warrant on the neighboring apt. I was assisted by a uniformed patrol officer. I did speak to a George A. Babcock, III, and his wife. They advised that there was no open access from the neighboring apt. To their residence. ...

para 4) Ms. Babcock went on to tell me that they had not had a good relationship with thier neighbor, Ms. Moore. Ms. Babcock stated that many times their house would be full of the odor of marijuana coming from the neighboring residence. [THE SMELL OF MARIJUANA IN THEIR HOUSE WAS COMING FROM THEIR OWN CHILDREN WHICH I HAVE OBSERVED ON MANY OCCASIONS ROLL AND SMOKE MARKIJUANA, ALSO PASSING A PIPE. AMOUNG THEMSELVES AND THEIR FRIENDS. THE CHILDREN OF THIS FAMILY OFTEN SMOKED MARIJUANA - I CAN OBTAIN SEVERAL WITNESSES TO THIS FACT. * ALSO I AM GOING TO PROVIDE YOU A LETTER FROM OUR LANDLORD WHICH WILL DOCUMENT THAT WE DO NOT SHARE AIR VENTS.]

Page 34 para 1) Mumma I also observed tax stamps on the counter area for Kansas drug law.

Para 4) ...I used a pry bar to open the north door of Ms. Debbie Moore’s side of the garage. After the doors were pryed open it was plain to see that the garage had been filled from top to bottom with a variety of boxes and personal items. This was left under the care and control of a uniformed officer until Det. Whittredge and his drug dog, Homer, could make a search of the garage area.

Para 5) During my talk with Ms. Babcock, I was told by her that they frequently saw her carrying items of green botanical nature into the garage, and from the garage into the house. Ms. Babcock told me this, prior to my opening the garage area by force, and that she could specifically say when she last saw this occur. [PLEASE NOTE THAT ANNUALLY I DRIED CATNIP THAT I HARVESTED FROM MY GARDEN, AND AFTER DRYING ON A SHEET IN THE SUN, I WOULD CLOSE THE SHEET WITH SAFETY PINS, AND BRING IN WHAT I NEEDED AS I DESIRED. THIS WAS NOT HIDDEN, OFTEN I WOULD PLACE THE SHEET ON THE TOP OF MY CAR TO OPEN IT, TO AVOID LOSING ANY OF THE DRIED LEAVES. SINCE THE WEATHER HAD BEEN FREEZING, EXCEPT FOR ABOUT ONCE A MONTH, WHEN I WOULD ADD BOXES TO THE EXISTING PILE, I NEVER OPENED THE GARAGE AT ALL.]

Para 6) ...occupied by Ms. Moore’s daughter, Mechelle. During the search of this bedroom, I recovered at 2330 hours a baggie which appeared to contain marijuana residue.

Page 35 para 6) ...I did assist Det. Stone by printing several bags of marijuana which were located in the residence. These bags were turned over to me by Det. Stone and after I had completed my processing of the bags for fingerprints I did submit these in the order that they had been given to me as 3 separate bags of evidence. These were submitted to the WPD lab with a request for testing.

Page 6 Police Report David Matthews (DOB 2 18 73) lists address as 1808 Diane, which is a lie! He has lived in a sexual relationship with Candida A. Babcock (DOB 4 14 81) since late 1994, at 2740 E. 2nd. Parents are in knowledge of, and approve of this relationship since they knowlingly allow David and Candida to live in the basement.

Candida A Babcock is in the 9th grade at East High.

Page 135 para 3) Allred As we were parked there watching the north side of the residence we observed a motor cycle pull into the drive. This drive being to the north of the residence. On the motor cycle there appeared to be two unknown individuals. These two individuals did go into the residence of 2740 E. 2nd.

Page 148 para 3) Johnson # 1226 Upon my arrival I went to the back of the residence, and observed several subjects sitting on a porch of what appeared to be a duplex to the west of 2742 E. 2nd. Once the residence had been secured, I asked Det. Mumma if he wanted me to talk with the individuals sitting on the porch. Det. Mumma advised to go ahead and talk with them and I then went back to where the subjects had been sitting and started talking with them. Para 4) The subjects were sitting on the back porch of 2740 E. 2nd. One of the subjects identified hiself as George Babcock, IV, 19, W/M, 6 11 76, 2740 E. 2nd, 683 0263. He advised that he did live at 2740 E. 2nd, and that 2740 E. 2nd was a separate apt on the west end of a residence that had been converted into a duplex. George Babcock advised that the entry to 2740 could not be made from 2742 unless someone possibly could go through the attic area which was a common area. Also on the porch was a white female, who gave the name of Candita Babcock, 14, W/FE, 4 14 81, also living at 2740 E. 2nd. A third subject gave the name of David G. David Matthews advised that he did know of some problems at the address of 2742 E. 2nd, and he knew why the police department was there. I did go into the residence of 2740 E 2nd, and was shown around the residence by George Babcock. George Babcock took me to the basement area where along the far east wall there did appear at one time to have been a door. The door had a metal bar across the inside of the door, and the door was sealed with caulking compound. George Babcock advised that the door could not be opened from the west side, being 2742 E. 2nd. David Matthews advised that he had done some work on the door however he was going to secure it even further in the future. I asked David Matthews if he got along with Debbie, who was the individual that Det. Mumma advised lived at 2742 E. 2nd.

Page 149 para 1) Johnson David Matthews advised that he did get along with Debbie to a certain extent, however it the past she had become rather upset because they had oil leaking from some of their vehicles and whether or not he got along was kind of a hit or miss thing as he described it. He stated that he tries to stay away from her, however sometimes that is not possible. I asked David Matthews if he knew of any drug activities at 2742 E. 2nd. David stated that he had seen Debbie carry in some what he described as bundles of funny little 5 pointed leaves, from her car wrapped in sheet. He advised she would take them to the garage, and then slowly move them into her residence. He stated that there is a lot of traffic going to 2742 E. 2nd, and sometimes it gets rather old having people come and go at all different times of the day and night from the neighbor’s address. This is the story of an on going case that is of special interest to me because I am one of the five cases mentioned in the article. My attorney is Charles O’Hara. If I lose this case, I ultimately could be sentenced to 40 years in prison through Kansas Hard Forty Mandatory Sentencing Laws. My case began on March 20, 1996 when law enforcement raided the educational and political action headquarters office of Kansas Environmentalists for Commerce in Hemp and confiscated my computer and files. See notes from police reports regarding wearing hoods and masks on the raids of March 20, 1996 and April 2, 1996, shown at the end of the following news paper article.

I apologize that it has taken me so long to submit this article, but I have been lobbying at our state capital, and I am employed at a full time job.

The Wichita Eagle

Title: Police hoods violate court order, judges say

Officers’ practice protecting themselves by wearing hoods over their faces is seen by some as intimidation.

The woman, pregnant with twins, was resting in bed when she heard the pounding on the front door. A moment later, a group of men wearing black hoods burst into the living room. “I thought, ‘What is this? A new way to rob houses?’ the woman said. That fear was not dispelled even after the men identified themselves as officers of the Wichita Police Department, there to serve a drug-search warrant on her husband. “I didn’t know what to think,” said the woman, who is not identified here because she has not be accused of a crime. “The first guy was in jeans and a button-up shirt and looked like a random guy off the street - not a cop. And even though they said they were the police, they had ski masks on.” The masks, know as balaclavas, are sometimes worn by undercover officers who enter homes with search warrants. Police said the hoods, which cover the face and head except for the area around the eyes, protect officers from being identified and possibly targeted by criminals for revenge. But some judges and defense lawyers said the way police are using the hoods is in open defiance of a court order that was designed to protect people’s right to reasonable searches and to know who their accusers are. Wearing hoods as a routine matter “is constitutionally and legally wrong,” Keith Sanborn said when issuing the court order six years ago. He is now retired and said in a recent telephone interview that he stands by his order. The order is still in effect because it has never been appealed,” he said. The order, with only limited exceptions, requires all law enforcement agencies in Sedgwick County to notify the judge issuing a search warrant that they are planning to use hoods. The agencies also are supposed to say how the hoods would protect them, other than to hide their identity. In recent cases, two sitting judges have found that the Wichita police violated the court order on three separate occasions. However, each time, the judges opted not to hand down any sanctions and ruled that the violation did not justify throwing out the evidence that was gathered by the hooded officers. The district judges, Joseph Bribiesca and James Fleetwood, declined to comment because the cases may be appealed. Police Chief Mike Watson also declined to comment on the cases, but vehemently defended the use of the hoods as a way to protect his officers. Across the nation, law enforcement agencies are split on the practice of wearing hoods. Police departments in Oklahoma City and Omaha use them, as does a task force made up of officers from three Florida agencies - the Volusia County Sheriff’s Department and the Edgewater and New Smyrna Beach police departments. But in Kansas, Wichita police are somewhat alone in wearing hoods. Agencies that don’t do it include the Bureau of Alcohol, Tobacco and Firearms, the Drug Enforcement Agency, the Kansas Bureau of Investigation, the Sedgwick County Sheriff’s Department and the Kansas City Police Department. To protect the identity of their undercover investigators, those departments have other officers serve the warrants. Some of those agencies only allow facial coverings when there is a physical threat to the officers - allowing them, for example, to wear flame-retardant hoods when searching drug labs containing flammable chemicals. In Wichita, the harshest critics of hoods are defense attorneys who said they are being used not as a legitimate tool to protect officers, but as a way to harass and intimidate suspects and their families. “Invading people’s homes wearing hoods in the middle of the night can be very scary,” said attorney Charles O’Hara. “What is the purpose, other than intimidation?” O’Hara is representing five defendants in drug cases involving hooded searches, and another lawyer, Jay Greeno, is representing one. Both have filed motions accusing the Police Department of violating the court order. “I’d be disbarred if I didn’t follow a judge’s rules,” O’Hara said. “But the police have gotten around the rules with little things like sending the first person into a home without a hood, and then having everyone else wear them.” Greeno scoffs at the Police Department’s justification that using hoods is necessary to protect the officers. “It’s hogwash that with 780 officers, they can’t find officers to do the raids besides those who do undercover work,” he said. “Why don’t you just send regular patrol officers in? No one would care about their identity.” But Doug Roth, Sedgwick County deputy district attorney, said using the same officers help prosecutors when the case ends up in court. “It can make things simpler for juries because we don’t have to call as many witnesses,” he said. O’Hara and Greeno say they have few remaining options for pushing the issue. Legal scholars agree. Had the police broken the law by wearing the hoods, the judges would have been required to impose a punishment, say Ray Spring, a law professor at Washburn University. But because they violated only a court order, judges are not required to do anything more than make their disapproval known. The lawyers could ask that the judges find the undercover officers in contempt of court. But O’Hara said it would be unfair to punish officers for doing what supervisors told them to do. They also could sue for civil rights violations, but O’Hara said he doubts that would work because juries unusually are not sympathetic to drug users. Police said they take steps to ensure suspects’ rights are not being violated. Wichita officers always announce themselves before entering a home, as required in a U.S. Supreme Court ruling. And they wear distinctive jackets or shirts that make them identifiable as police officers. The defense attorneys and Sanborn say that is not always enough. “If you’re serving a search warrant authorized by the court, people have a right to know who you are,” Sanborn said. But Roth, the deputy district attorney, contends that Sanborn’s 1992 order was too sweeping in that it prohibits all law enforcement agencies in Sedgwick County from doing something. The judge did not have the authority to do this, Roth said, because none of the agencies were parties in the case. The State of Kansas was the plaintiff, and Wichita police officers were witnesses. He said the wearing of hoods is a question of reasonableness under the law and should be addressed case by case. The technicalities of the legal arguments are little comfort to the woman who was in bed when the police came in. She said they barged through her house, overturning dresser drawers and frightening her children, ages 2 and 7. The officers did not show badges, she said, and searched the house for an hour and a half before presenting her with the search warrant. Uniformed officers arrived after that. Police left with a small amount of marijuana. The charges against her husband stem mainly from drugs discovered at another location, O’Hara said. A judge has yet to be assigned the case, but O’Hara already has filed a motion to suppress the drug evidence. If the motion is denied like the others before it, O’Hara said he won’t give up. “The judges see that the hoods are wrong, so we’ve won the battle - just not the war,” he said.

Public Opinion Letters March 2, 1998

Letter 1) Wichita police cover up their heads in hoods, kick down the doors and rush in (“Police hoods violate court order, judges say,” Feb. 23). This is not how our forefathers intended reasonable searches to be made. Let’s stop this abuse of our Fourth Amendment rights.

Letter 2) Following the logic that undercover police need to wear hoods to protect their identity and prevent acts of revenge, wouldn’t judges in court also be hooded to protect them from those they sentence? Then juries should also be hooded. Then officers in patrol cars.

Page 26 para 1 Crump report by BJS May 3, 1996 On the afternoon of 4-1-96 while assigned to the SIB of the WPD I contacted special agent Pete Staceyu of the secret service in reference to two letters that I had found in Debora Moore’s bedroom when we had executed the search warrant. I had called agent Stacey due to the fact that one of these letters was written on White House Stationary and it appeared from reading this letter that the person writing it was wanting to send Debora Moore a plane ticket in exchange for “something good for my sole”, which I suspected to be marijuana. I knew that if this person did indeed work at the White House that he had to have a security clearance in order to do that and I thought that the secret service needed to know about this.

On 4 1 96 at approx. 1645 hours special agent Pete Stacey from the secret service did come over to our office and I did photocopy these two letters as well as a photocopy of the envelope that one of the letters was in and I released these photocopies to him.

A copy of the evidence release form was placed into a file.

Page 19 Para 3) After I went to the computer room which Det.

Page 19 Para 4) The Computer was setting on a desk on the north wall of the computer room. Upon examining the computer I saw that it was a dynamix computer with a possible serial number of A1601551. Across the top of the housing of the computer was written in dark colored ink or paint, the words “Debbie Moore and then a number which appeared to be a SS number of 515 48 0429.
